Terms of Service Sellvia

Please read these Terms of Use (“Terms”) carefully before using the https://sellvia.com website (the “Service”) and the Sellvia Plugin (Software) operated by Sellvia LLC (“us”, “we”, or “our”).

Your access to and use of the Service and Software is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service and Software.

By accessing or using the Service and Software you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. SUBSCRIPTION PLANS, COOPERATION MODEL & COMMISSION
Sellvia LLC may offer new subscription plans and may change them and their features from time to time. If you sign up for a subscription plan, you agree to the terms, conditions and limitations associated with them that are published on sellvia.com.

1.1 Sellvia Subscription with a Free Turnkey Store
1.1.1 Description of the Service
The Sellvia subscription provides access to a Sellvia account where you can manage your subscription and monitor your orders and also provides you with a free turnkey store with access to thousands of products of the Sellvia Catalog available for import. The Sellvia plugin helps you place orders at the Sellvia Fulfillment Center that will organize delivery to customers.

The subscription also includes a Free Turnkey Store – a WordPress site with the Sellvia platform plugin and a hosting service.

1.1.2 Sellvia Free Turnkey Store creation includes:
Free domain name* (unless a premium or own domain is selected in the survey)
Hosting
One branded email address (support@your.domain)
Access to Sellvia Catalog to import Sellvia products with reviews
50 random Sellvia products uploaded into your store by default
Mailing service setup
Basic SEO meta data
When filling in the survey for the free store, you can also add some additional paid services which are not part of the trial and will be charged immediately after submitting the survey. The additional services may include:

Paid theme
Premium domain
Product Сatalog Upgrade service (importing additional products into your store)
Premium Products creation service (designing unique custom products for your store)
Social Media Package service (creating social network pages for your store and providing the content to post on them for an agreed period of time)
The Free Turnkey Store creation does not include:

Paid theme installation
Premium domain
Product Сatalog Upgrade service (importing additional products into your store – see 2.2. Product Catalog Upgrade)
Social Media Package service (creating social network pages for your store and providing the content to post on them for an agreed period of time – see 2.3. Social Media Packages)
Promo Tools Service (installing addons that help to increase conversion rate on your site – see section 2.5 Promo Tools Bundle)
Other services
These tasks can be set up by the customer with the support guidance. Social pages creation can be ordered as a paid service.

*Free Domain

The domain is provided free of charge and owned by Sellvia. After the initial domain registration period expires, it becomes the customer’s responsibility to renew the domain. When the domain expires, Sellvia will send you a domain renewal invoice that will allow you to renew the domain. We guarantee that the domain will not expire for at least three months since the completion of the survey.

Own Domain

If you prefer to have your Sellvia Free Turnkey Store built on your own domain, you must first select any free domain in the survey and then email support@sellvia.com requesting to use your personal domain instead. Your domain must be purchased and active prior to making this request. The first domain switch to your custom domain is free; each additional change (starting from the second) requires a one-time payment of $29.

The stores with the own domain can only be built after the ns-records of your domain have been changed to the ones the support team provided to you in an email after your order for Sellvia pro has been placed and the changes get applied (it can take up to 48 h with some of the domain registrars), thus you can receive your turnkey store after more than one business day since the day of purchase. After the ns-records are changed successfully, it usually takes about one or two business days to move the store to the new domain and provide you with the store access details.

Please note that we do not set up redirects from your old Sellvia domain name to your new one after the domain name change.

Hosting

The hosting meets all the needs of the site but has limited management options. The tasks that require access to the hosting settings are done via third-party plugins or by contacting support@sellvia.com.

The store and its hosting are provided as part of the offer as long as you have the Sellvia subscription active on your site.

If Sellvia Pro subscription is not renewed for longer than a week since the day of the due payment, your site data may be irreversibly deleted.

One Turnkey Store per one Sellvia Subscription

A single customer account (email) may create up to 10 Turnkey Stores, each tied to a separate Sellvia subscription.

By clicking “Create a Store” in your Sellvia dashboard, you agree to the creation of a new subscription associated with the new store. Each subscription is billed at $39/month, and the first charge occurs immediately upon creation of the new store.

Please note the following:

You may create up to 10 Turnkey Stores and corresponding subscriptions under one email.
Each Turnkey Store and its associated subscription operate independently.
Purchases or services (Auto Ads, product packages, etc.) made for one store do not transfer or apply to your other stores.
Commissions, payments, orders, or services tied to one store cannot be moved or shared between stores.
To cancel any store and its corresponding subscription, please contact support@sellvia.com or cancel your subscription in Sellvia dashboard.
Incompatibility with WooCommerce

The Sellvia platform plugin used in free turnkey stores is not compatible with other ecommerce plugins, including but not limited to WooCommerce, AliDropship, or any third-party plugins or themes designed for use with those systems. Installing, activating, or attempting to substitute the Sellvia plugin with such plugins may cause site errors, malfunction, or loss of functionality.

Sellvia is not responsible for issues arising from such installations.

1.1.3 Sellvia Subscription Plans
1.1.3.1 Sellvia PRO

Sellvia PRO offers three subscription plans: Basic, Advanced, and Ultimate.

Subscription pricing: $39 per month, $99 per month, or $299 per month.

Free trial: 14 days (starting from the date your store access details are provided).

The Sellvia Basic plan allows for up to 5,000 products and includes 4 GB of available server space – priced at $39 per month.

The Sellvia Advanced plan allows for up to 10,000 products and includes 10 GB of available server space – priced at $99 per month. This plan becomes available after completing payment for at least three consecutive months.

The Sellvia Ultimate plan allows for up to 20,000 products and includes 50 GB of available server space – priced at $299 per month. This plan also becomes available after completing payment for at least three consecutive months.

Plan Upgrade

A customer can upgrade the plan in Sellvia account -> Plans tab or by contacting Sellvia Support at support@sellvia.com.

1.1.3.2 Sellvia Performance Tiers

In addition to the Sellvia PRO subscription plans described above, Sellvia may offer an optional add-on subscription known as Sellvia Performance Tiers (“Performance Tiers”).

Sellvia Performance Tiers are designed to scale with a Customer’s operational activity and provide access to expanded platform tools, features, and usage limits based on the selected tier. Performance Tiers are supplementary to Sellvia PRO and may only be used in conjunction with an active Sellvia PRO subscription. Performance Tiers do not replace, modify, or reduce the requirements of the Sellvia PRO subscription.

Performance Tiers are service access subscriptions. They do not represent customer funds, stored value, credits, deposits, balances, financial accounts, or payment instruments, and they do not create any right to receive money, interest, or payouts.

Performance Tier Levels

Sellvia may offer the following Performance Tiers, subject to change from time to time. Specific features, limits, and tool availability for each tier are defined in the Sellvia Dashboard or applicable service descriptions.

Basic Tier (Free)
Provides limited access to Performance Tier functionality and supports up to 50 orders, with restricted feature availability.

Plus Tier ($19 per week)
Provides access for up to 100 orders and includes selected platform tools, which may include:

Google Backlinks Tool
Advanced Tier ($39 per week)
Provides access for up to 250 orders and includes:

Email Marketing Tool
Google Backlinks Tool
Social Media Marketing Tool
SEO Blog Posts Tool
Design Customization Tool

Provides access for up to 500 orders and includes:

Email Marketing Tool

Elite Tier ($99 per week)
Provides unlimited order capacity and access to the full set of Performance Tier tools and features made available by Sellvia at the time of subscription, including:

YouTube Marketing Tool
Promotional Videos
Instagram & TikTok Ads Tool

Order thresholds, tool availability, and feature scope may vary by tier and may be updated at Sellvia’s discretion.

Billing, Renewal, and Relationship to Sellvia PRO

Performance Tiers are billed separately from the Sellvia PRO subscription and follow an independent billing cycle, as disclosed at the time of purchase. No additional processing, transaction, or service fees are applied to Performance Tier subscription payments.

Upgrading, downgrading, or canceling a Performance Tier does not affect the billing, renewal, or validity of the Sellvia PRO subscription. However, if the Sellvia PRO subscription is canceled, suspended, or expires, access to all associated Performance Tier features will be automatically suspended until the Sellvia PRO subscription is reactivated.

Performance Tier upgrades may occur automatically based on Customer usage, including but not limited to activating additional tools or reaching applicable order volume thresholds. Automated upgrades ensure continued access to required platform features and do not modify the underlying Sellvia PRO subscription. Any applicable tier changes and pricing are displayed in the Sellvia Dashboard.

Customers may request a downgrade by contacting Sellvia Support. Downgrade requests are subject to review and may be approved only if the Customer’s current account activity, enabled tools, and usage levels are compatible with the requested lower tier. Sellvia reserves the right to decline downgrade requests that would result in feature incompatibility or service disruption.

1.1.4 Signing up
In order to subscribe, you need to provide your email and credit card details on the checkout page.
By providing these details and signing up, you agree to the present terms, confirm that you are aware that the Sellvia subscription is a recurrent payment that will continue automatically and authorize Sellvia subscription payment to be collected after the end of the trial from the card that you provided when signing up unless you notify us before the charge is made that you would like to cancel the subscription or unless you cancel your subscription yourself in your Sellvia account.

1.1.5 Trial
The free trial starts on the day when the store access details are granted to the subscriber during the free training session with the Sellvia consulting team or sent in an automated email. The store is built immediately after we get the survey with your preferences indicated.

1.1.6 Renewal of the Subscription
After the free trial period ends, your subscription payment will be automatically charged to the payment method you provided. By entering your payment information and subscribing, you explicitly consent to the automatic renewal of your subscription at the end of the free trial period. You authorize Sellvia to charge your payment method for the subscription fee once the trial period expires.

It is your responsibility to ensure that your payment method has sufficient funds available to cover the subscription renewal before the payment due date. By subscribing, you also acknowledge and agree to the terms regarding renewals, cancellations, and refunds as outlined here.

Reminder of Renewal: You will receive a reminder email 3 days before the trial period ends. If you do not wish to continue, you may cancel your subscription by following the cancellation instructions in the reminder email or by accessing your User Account.

1.1.7 Cancellation
You can cancel your subscription or any renewing paid services at any time through your User Account. To cancel, go to “My Account” → “Plans,” click on the options menu (three dots), and select “Unsubscribe and Delete Store.” After completing the cancellation process, you will receive a confirmation email indicating that your subscription has been successfully canceled.

Impact of Cancellation:

Free Turnkey Store: Your Free Turnkey Store will be canceled when you cancel your Sellvia subscription.
Access to Features and Commissions: After cancellation, your access to Sellvia features, including commission functionality, will be suspended. However, any commission earned up to the cancellation date will remain redeemable until the end of the paid period, provided all orders are processed according to Sellvia’s operational procedures. Commission will not expire automatically after cancellation.
If you wish to redeem any available commission after cancellation, please contact Sellvia support before the end of the paid period to process your request.
1.1.8 Refunds
Refund Eligibility: Sellvia provides a 100% refund for the latest subscription payment if requested within 30 days of the payment date. To request a refund, please contact support@sellvia.com. Refund requests made after 30 days will not be processed, and your subscription will remain active until the end of the paid period.

Annual Subscription: Refunds for annual subscriptions are available only upon request within 30 days from the date of the annual payment charge. If requested after 30 days, no refund will be issued. The yearly fee for the used portion of the subscription is non-refundable.
Monthly Subscription: Refunds are only available for the current payment period. Refunds for previous months are not issued.
Additional Services: Once additional services (such as dashboard services or services ordered with the Free Turnkey Store) have been initiated, they are non-refundable.

1.1.9 Termination of Service
In case the subscription has not been paid on a due date, it becomes inactive immediately. After 7 days, Sellvia deactivates its hosting and deletes the Free Turnkey Store that is part of Sellvia Pro. The deleted Free Turnkey Store cannot be recovered. We will send at least one reminder to the account email before deletion.

1.1.10 Multiple Accounts Policy
You are not permitted to create, maintain, or control more than one account without our prior written consent. Creating multiple accounts for the purpose of:

Circumventing usage limits or restrictions
Gaining access to promotional credits or offers
Manipulating referral systems
Engaging in fraudulent or abusive behavior is strictly prohibited.
We reserve the right to identify and link related accounts based on shared attributes such as email domains, IP addresses, device fingerprints, billing information, or usage behavior.

1.1.11 Automated Account Creation
The use of bots, scripts, automation tools, or any other method to mass-create accounts is not allowed. Any accounts created in this manner may be suspended or deleted without notice.

1.1.12 Transactional Abuse and Chargebacks
If we detect suspicious, excessive, or abusive transaction activity (including but not limited to repeated chargebacks, payment fraud, or attempts to exploit our refund policy), we may:

Temporarily or permanently suspend your account(s)
Deny access to future transactions
Share relevant information with payment processors or legal authorities
We reserve the right to contest chargebacks and provide evidence of policy violations to the payment processor.

1.1.13 Email Domain Abuse
We monitor for abuse patterns involving multiple accounts registered with the same email domain. If we detect high-risk activity from a specific domain, we may limit or block new registrations, pending manual review.

1.1.14 Right to Terminate or Restrict Access
We reserve the right to suspend, restrict, or terminate any account — or group of related accounts — that we reasonably believe is violating these Terms of Service or engaging in abusive behavior. This includes but is not limited to:

Fraud
Spam
Misuse of the platform
Attempts to exploit the system
1.1.15 No Right to Service in Case of Abuse
Users found to be in violation of this policy waive any rights to continued access to the platform, services, or stored data. Refunds or disputes related to terminated accounts may be denied at our sole discretion.

1.1.16 Changes to This Policy
We may update these terms at any time. Continued use of our services after any changes indicates your acceptance of the updated terms.

1.2 Cooperation Model and Relationship of the Parties
1.2.1 Partner Storefront Model
When a Sellvia Customer activates Sellvia Payments (as described in Section 1.3 Sellvia Payments), the Customer’s Sellvia Turnkey Store will be classified as a “Partner Storefront,” and the Customer will be designated as a “Partner.”

A Partner Storefront functions as a promotional and pre-checkout interface operated by the Partner. The Partner Storefront displays product information, collects customer shopping intent, and directs customers to Sellvia Mall (Sellvia’s ecommerce site) for order completion.

The Partner does not sell goods directly to end consumers and does not receive or handle customer payments. The Partner may be allocated Sellvia-funded promotional incentives (“Commission”) under Sellvia’s promotional programs. Such incentives are not derived from customer payments or product sales and do not constitute revenue, wages, or amounts owed.

1.2.2 Customer-Managed Payments Model
If a Sellvia Customer does not activate Sellvia Payments, their store operates under the Customer-Managed Payments Model.

Under this model, the Customer uses their own independently operated payment system, processes customer transactions autonomously, and acts as the seller to the end customer for all transaction-related purposes. Sellvia does not participate in or oversee any customer payments made through the Partner’s checkout system.

The Partner is fully responsible for managing customer orders, transaction records, payment disputes, refunds, fraud risks, regulatory compliance, and all other obligations associated with handling customer funds.

Sellvia’s role is limited to supplying products and fulfilling orders submitted by the Partner, and Sellvia has no involvement in or control over the Partner’s customer-facing transactional activities.

1.3 Sellvia Payments
1.3.1 Overview
Sellvia Payments is a built-in payment infrastructure used to process orders accumulated on Sellvia’s ecommerce site.

Payments are processed strictly through Sellvia’s accounts. Sellvia is responsible for payment acceptance, receipts, and payment-related refunds/chargebacks under Sellvia’s policies.

1.3.2 Eligibility and Use
To activate Sellvia Payments, Customer must maintain an active Sellvia Subscription and a live, functioning website. Sellvia reserves the right to review, suspend, or revoke access to Sellvia Payments in cases of suspected fraud, abuse, or violations of applicable terms or policies.

1.3.3 No External Gateway Required

When Sellvia Payments is enabled, Sellvia manages all aspects of payment acceptance.

1.4 Commission
1.4.1 Definition
Commission is an internal non-cash promotional incentive associated with a Partner’s Sellvia Account. Commission represents a Sellvia-funded, non-cash promotional incentive allocated through qualified Partner activity such as referred traffic, conversions attributed to Partner Storefront performance, or other actions defined by Sellvia’s Partner Programs.

Commission is NOT:

– customer money,

– sales revenue,

– a deposit account,

– stored value,

– electronic money,

– escrow,

– or funds held on behalf of the Partner.

Sellvia is not a financial institution. No interest is earned on Commission, and it may only be used in accordance with the applicable terms of Sellvia’s services.

No Money Transmission or Custodial Services

Sellvia does not provide money transmission, stored value accounts, wallets, escrow, custodial services, or payment settlement services for third parties. Sellvia does not hold, pool, route, or transfer customer funds on behalf of users. Any commissions, credits, incentives, or balances referenced in these Terms represent internal, non-cash promotional or prepaid service units funded solely by Sellvia or prepaid services delivered by Sellvia.

1.4.2 Commission Structure
Commission is represented in one of the following states:

(a) Incoming Commission (Pending)

Before any Commission is allocated or becomes Available, it is placed in a Pending state for up to seventy-two (72) hours. The Pending state allows Sellvia to verify referred activity, confirm order completion, ensure proper attribution, and detect or prevent abuse, fraud, or policy violations.

(b) Available Commission

Once the Pending period concludes, Commission is reclassified as Available Commission, representing a Sellvia-funded promotional incentive eligible for redemption consideration, subject to these Terms.

Note: Available Commission represents non-cash promotional incentives funded exclusively by Sellvia. This Commission is not derived from customer payments and does not represent sales revenue.

Ownership and Payout Condition

Until the Partner submits a valid payout request and all applicable eligibility conditions are satisfied, including the absence of outstanding unpaid service fees, Available Commission remains a Sellvia-funded promotional incentive and the property of Sellvia.

Commission does not become payable, transferable, or owed to the Partner until a payout is approved in accordance with these Terms. The existence of Available Commission does not create a debt, obligation, or custodial relationship between Sellvia and the Partner.

1.4.3 Commission Payouts Policy
1.4.3.1 Commission Payouts

Commission represents a Sellvia-funded, non-cash promotional incentive allocated in connection with Partner activity and does not constitute customer payments, stored value, wages, or product sales revenue. Sellvia is the sole payer of Commission upon approval.

Commission payouts represent the redemption of Sellvia-funded promotional incentives and do not constitute settlement of customer payments or transfer of third-party funds. Partners may request a payout of their Available Commission once specific eligibility requirements are met.

To redeem your Available Commission, the following conditions must be met:

Your Sellvia subscription must be active and fully paid at the standard plan rate ($39 for Basic, $99 for Advanced, or $299 for Ultimate).
All orders associated with your Partner Storefront must be fully processed in accordance with Sellvia’s operational procedures.
Partners may request a payout of their Available Commission by accessing the Dashboard, selecting the “Redeem Commission” option, and completing the on-screen steps. The minimum amount is $100 for U.S. residents and $300 for residents of all other countries.

1.4.4 Important Disclaimers
All Commission payouts are made solely from Sellvia’s corporate funds as promotional incentive payments and do not involve the holding, routing, or transfer of customer funds, product sales revenue, or any form of payment settlement. They represent the payout of qualified promotional incentives allocated by Sellvia.

Sellvia reserves the right to deny, delay, adjust, suspend, or reverse Commission payout requests in the event of suspected fraud, traffic manipulation, chargebacks, disputes, policy violations, or unresolved account issues.

All payout requests are subject to applicable Payouts Policy, compliance reviews, and identity verification procedures required for tax reporting, fraud prevention, or payment processing compliance.

1.5. Paid Services
Certain Sellvia Services may require payment of specific costs as determined solely by Sellvia (“Paid Services” and “Charges and Fee(s),” respectively).

Sellvia will inform you of the current Costs, which you must pay directly to Sellvia via your Sellvia Dashboard when purchasing Paid Services. To access or use these Paid Services, all applicable Costs must be paid in advance.

Sellvia reserves the right to modify its Costs at any time and at its sole discretion.

All Costs paid directly to Sellvia are considered to be in U.S. Dollars, unless explicitly stated otherwise in writing by Sellvia. Where permitted by law (and unless Sellvia specifies otherwise in writing), all Costs are exclusive of taxes (including VAT, sales tax, goods and services tax, etc.), levies, or duties imposed by tax authorities (“Taxes”), and you are responsible for paying any applicable Taxes related to your use of Sellvia Services or any transactions or purchases you make. If Sellvia is required to collect or pay Taxes on the Costs you owe, such Taxes may be added to any outstanding Costs and will appear on your Invoice. We suggest checking for any additional costs that may be charged by third parties in relation to the purchase or renewal of Paid Services (such as international transaction charges, currency conversion charges, or charges from banks or credit card companies). Sellvia is not liable for any such additional costs.

If you buy Paid Services directly from Sellvia, by registering or submitting information for such services, you also authorize Sellvia to request and collect payment and service costs (or to initiate refunds, charges, or any other billing actions) from your payment provider or designated bank account. Sellvia may also make necessary inquiries to verify your payment account or financial details to ensure timely payment, including obtaining updated payment information from your payment, credit card, or bank account provider (e.g., updated expiry date or card number as provided by your credit card company).

You must maintain a stored credit card with Sellvia to pay for Paid Services purchased directly from Sellvia (“Stored Card”). You can identify your Stored Card by the last four digits displayed on your Account Settings Page.
